SCOTUS: The First Amendment and Separation of Powers are still things!

To recap a whirlwind past two days of U.S. Supreme Court decisions: 





I weighed in Thursday on the Students for Fair Admissions, Inc. v President and Fellows of Harvard College ruling, a case with resulted in the overturning of "affirmative action" (aka racial discrimination) in the college admissions process. 


Then on Friday, SCOTUS finally took a firm stance on whether or not business owners can be compelled to use their creative talents for causes, events, etc. which violate their religious beliefs. 


The U.S. Supreme Court held that a Colorado graphic designer who wants to make wedding websites does not have to create them for same-sex marriages, in a landmark decision that pit the interests of LGBTQ non-discrimination against First Amendment freedom.

In a 6-3 decision issued Friday, the high court ruled in favor of artist Lorie Smith, who sued the state over its anti-discrimination law that prohibited businesses providing sales or other accommodations to the public from denying service based on a customer's sexual orientation.

Justice Neil Gorsuch authored the majority opinion, which said that, "In this case, Colorado seeks to force an individual to speak in ways that align with its views but defy her conscience about a matter of major significance."

"But, as this Court has long held, the opportunity to think for ourselves and to express those thoughts freely is among our most cherished liberties and part of what keeps our Republic strong," Gorsuch continued.

"But tolerance, not coercion, is our Nation’s answer. The First Amendment envisions the United States as a rich and complex place where all persons are free to think and speak as they wish, not as the government demands. Because Colorado seeks to deny that promise, the judgment is reversed," he concluded.


Many leftists and media outlets (and heck, even two of the dissenting Justices) have been misrepresenting the facts of this case by essentially saying the Court is legalizing discrimination against the LGBTQ community. 


 

The fact is no one has ever looked to deny a business relationship with people because they're gay. No, the issue is providing a service which is part of an exercise the business owner personally believes violates his/her beliefs. For instance, Masterpiece Cakeshop owner (and devout Christian) Jack Phillips will gladly sell anyone a cake but he will not decorate it to commemorate a same-sex wedding. These rules also apply to, say, a Muslim artist who can not be forced to create a portrait caricaturing the prophet Mohammed.  


And then there was the "student loan debt case." 


In a 6-3 decision, the court held that federal law does not allow the Secretary of Education to cancel more than $430 billion in student loan debt.

"The Secretary’s plan canceled roughly $430 billion of federal student loan balances, completely erasing the debts of 20 million borrowers and lowering the median amount owed by the other 23 million from $29,400 to $13,600," Chief Justice John Roberts wrote for the majority. "Six States sued, arguing that the HEROES Act does not authorize the loan cancellation plan. We agree."


Again, progs do what they always do in that they let feeling and emotion cloud the legal aspect. Quite simply, a President of the United States does not have the "power of the purse," thus he can't unilaterally draft fiscal legislation. Heck, from January 2021 thru December 2022 (nearly two years), Dems had full control of Congress plus the White House. If this legislation was so critical, why not use the actual tools of our representative republic by having the House and Senate pass a bill? 


As news of this ruling broke, there were many leftists on Twitter essentially saying that this decision robbed people of $10,000. That's an absolute warped perspective since student loan recipients made an active decision to borrow money with the intention of paying it back. In no sane society is it robbing someone when they're instructed to fulfill an obligation to which they personally committed. 


In all seriousness, as tempting as it is to gloat as well as engage in a proverbial end zone happy dance, our progressive friends need some compassion. As I've said in this space on myriad occasions, leftists look at government as a deity, so it's easy to understand why they're likely in a bad way this week. While they probably aren't ready to hear this yet (if they are ever be able to), the fact is the government is comprised of flawed human beings. As such, lefties are inevitably going to be wronged because people they support for elected office may be idealistic at first but will ultimately devolve into power-hungry beings. In essence, the needs of the people become expendable.

SCOTUS rules against racist policy; Progs fume

What a time we're living in when some people are outraged over a U.S. Supreme Court ruling which overturns a racist policy. 

The U.S. Supreme Court handed down a major ruling on affirmative action Thursday, rejecting the use of race as a factor in college admissions as a violation of the 14th Amendment's Equal Protection Clause.

In a 6-3 decision, Chief Justice John Roberts wrote in the majority opinion that, "A benefit to a student who overcame racial discrim­ination, for example, must be tied to that student’s courage and determination."

"Or a benefit to a student whose herit­age or culture motivated him or her to assume a leadership role or attain a particular goal must be tied to that student’s unique ability to contribute to the university. In other words, the student must be treated based on his or her ex­periences as an individual—not on the basis of race," the opinion reads.

"Many universities have for too long done just the oppo­site. And in doing so, they have concluded, wrongly, that the touchstone of an individual’s identity is not challenges bested, skills built, or lessons learned but the color of their skin. Our constitutional history does not tolerate that choice," the opinion states.


But it was Justice Clarence Thomas's concurring opinion which took a proverbial blow torch to this case. 

 

"The solution to our Nation’s racial problems thus cannot come from policies grounded in affirmative action or some other conception of equity," Thomas writes. "Racialism simply cannot be undone by different or more racialism. Instead, the solution announced in the second founding is incorporated in our Constitution: that we are all equal, and should be treated equally before the law without regard to our race," he adds. "Only that promise can allow us to look past our differing skin colors."

Elsewhere in his concurring opinion, Thomas lays bare the left's flawed — and quite racist — beliefs about different races.

"In fact, all racial categories are little more than stereotypes, suggesting that immutable characteristics somehow conclusively determine a person’s ideology, beliefs, and abilities. Of course, that is false," Thomas notes. "Members of the same race do not all share the exact same experiences and viewpoints; far from it," he explains. "A black person from rural Alabama surely has different experiences than a black person from Manhattan or a black first-generation immigrant from Nigeria, in the same way that a white person from rural Vermont has a different perspective than a white person from Houston, Texas."


Perhaps what was most telling in the aftermath of this decision was how so many progs unwittingly let their racism flag fly. 


A former staffer in President Joe Biden's administration perfectly encapsulated what a lot of leftists were conveying. 


 



And I almost choked on the thick irony of Fauxcahontas' Sen. Elizabeth Warren's reaction. 


 



This from the woman who exaggerated her Native American heritage in order to benefit from affirmative action policies. It never ceases to amaze how these smug elites thoroughly lack any self awareness.


In the end, as Brad Polumbo notes, colleges have the potential to be even more diverse without utilizing affirmative action. 





The saber rattling among leftists will carry on for maybe another day or two.....or until the inevitable ruling which will throw out President Biden's policy canceling student loan debt.

Quick Hits: Volume CCCXIX

 - The 2SLGBTQIA+ crowd (yes, I just learned 2S is a thing) and their "allies" take great exception to some of their members being labeled as "groomers." Such a label was affixed when dudes in drag started "twerking" in front of kids. Ah, but we were emphatically told that such incidents were isolated and that the majority of kids' exposure to drag queens was merely having books read to them. 


So when shocking video footage emerged from Pride parades over the weekend, including an LGBTQ group chanting that they're coming for kids, leftist TV network NBC went into spin mode. 





Then we see this: 


 



What a remarkable coincidence. Dare I say "mission accomplished?"



- Vice President Kamala Harris has a historically low approval rating, plummeting to a net-negative of -17. 


I guess we're all racist misogynists now, eh Jimmy Kimmel



- The son of a far left former MN state rep was charged with 10 counts of vehicular homicide by a typically lenient prog county attorney. No political favors. No grandstanding by Hennepin County Attorney Mary Moriarty. Granted these should be low bars to clear but with a society teetering ever closer to a Banana Republic, this almost seemed to be going along too smoothly.


Leave it to the radical Council on American-Islamic Relations (CAIR) to attempt to muddy the waters


Somali Americans grieving the five young women killed by a speeding driver want answers.

Among their questions: Who was responsible for the unauthorized release of the crash video that went viral on social media? Why did the suspect in the crash, Derrick Thompson, have his license reinstated in Minnesota after he was imprisoned for a 2018 hit-and-run in California? What was the involvement of the state trooper who began following Thompson's rented SUV after it sped past him on Interstate 35W just before the SUV left the interstate and slammed into the women's car?

"We are asking the governor of the state of Minnesota to create an independent investigation into this case," said Jaylani Hussein, executive director of the Council on American-Islamic Relations in Minnesota.


Emphasis was mine. 


While outrage over the release of video footage is a red herring, I concur that there has to be answers for why Thompson had his license reinstated. But the insinuation that law enforcement was at all complicit in this incident smacks of mere pig piling upon Minneapolis' favorite foil -- the cops. 


The Minnesota Police & Peace Officers Association responded: 





This incident was avoidable and never should have happened, so I can certainly understand how a community is struggling to come to grips with this senselessness. But this appears to be nothing more than a situation where a young man's poor life choices resulted in the tragic deaths of five innocent people. As such, the women and their families will get justice since Thompson will likely never see the light of day again. Focusing energy elsewhere will only serve to gouge at already deep emotional wounds.

Quick Hits: Volume CCCXVIII

 - Five young women were killed last Friday evening when a 27-year old man named Derrick Thompson burst through a red light at a high speed and t-boned the vehicle containing the women (WARNING: video footage of the incident is quite shocking). Thompson, who is the son of former Minnesota State Rep. John Thompson (DFL-St. Paul), had previously been convicted of a reckless driving charge in 2018 while in California. He was released early despite receiving a sentence of 8 years


What's telling is that there seems to be more outrage over unauthorized release of video footage of this incident as opposed to how a convicted felon was able to get out of a previous jail sentence so early. And given the fecklessness of new Hennepin County Attorney Mary Moriarty, there's legit concern that the younger Thompson may not be sufficiently punished for this latest incident. 


Gov. Tim Walz weighed in on Monday. 





Funny how Walz shows disdain for those who extend thought and prayers to the families of shooting victims, yet here he deems it sufficient when a repeat felon (and son of a 2020 legislative candidate whom Walz endorsed) kills five ladies traveling to a family member's wedding. 


But don't think for one second progs didn't attempt to deflect attention away from the actual person responsible for this tragedy.





Co-opting Juneteenth in an attempt to own the cops. Soulless ghouls.

A friendly reminder: A GOP presidential candidate likely has zero path to 270 Electoral Votes without Arizona and Georgia (see: 2020 presidential election).  



- As Sen. Tim Scott (R-SC) found out when visiting the venomous panel on ABC's The View, progs don't much care for black folks like himself who don't believe America is an oppressively racist nation. 


Then last week, former President Barack Obama took exception to Scott's notion that grit and determination are enough for any American (yes, even black people) to attain success in this country. But as Erick Erickson astutely observes, Scott would seem to have more credibility than Obama in this debate. 

 

Tim Scott grew up in the heart of the Confederacy — Charleston, SC — and was raised in working-class poverty as the descendant of slaves and went to public schools.

Barack Obama is a descendant of Irish settlers on his mother’s side, and his father is from Kenya. Tim Scott is the descendant of slaves on both sides.

It is really notable that Obama and Scott are both from broken homes, but the one who got to travel the world and go to a private school in Hawaii wants to lecture the South Carolina descendant of slaves about race and opportunity in America.

Democrats fear Tim Scott. He is a threat to their coalition, and Barack Obama knows it. 


It's doubtful Tim Scott will break through to be the GOP nominee for President next year. That said, whomever emerges as the Republican candidate would be wise to have a place for Scott in their general election campaign.

A true occasion to celebrate

It was 158 years ago today, nearly 2-1/2 years after President Abraham Lincoln signed the Emancipation Proclamation, that the last slaves in the U.S. were freed. This occurred when Union Army Gen. Gordon Granger came to Galveston, TX a few weeks after the Civil War ended to inform the only remaining enslaved people that they were indeed free. 

Even though this occasion has been celebrated annually since 1866, President Joe Biden in 2021 signed legislation declaring Juneteenth a Federal holiday. 

For obvious reasons, black Americans have celebrated this occasion far more passionately than others. However, as Jack Hunter at Based Politics points out, this new holiday is a time for all Americans to rejoice as much as we do every 4th of July. 
 
(I)t truly is a no-brainer holiday for anyone who values human freedom to celebrate.

For liberty.


I'm absolutely in favor of young people learning about all facets of America's history, even the  proverbial warts. So if they're to learn about the abhorrence of slavery, shouldn't they also be cued into the fact we also live in a country with a governmental system designed to end such immorality?

Extreme idiocy

I've talked ad nauseum about the far left radical policies that emerged from this most recent Minnesota legislative session that there really isn't a lot more to say on the substance of these new laws. However, now is a good time for right-of-center activists to focus on helping wrest control of House from the DFL next year. 

In the aftermath of this year's legislative session, I remarked that the DFL and their well-funded PACs no longer have any moral authority to label GOP candidates as "extreme" given the buffet of legislative lunacy that the Dems pushed through this year. Oh sure, they'll continue to trot out that rhetoric, but any Republican candidate should be able to easily swat that away.


  • "Wait, you voted for killing a child until literally moments before birth, but *I* am the one who's extreme?!?!?"
  • "This state had a near $18 billion budget surplus and not only did you vote to spend every penny, you also voted to increase taxes and fee in other areas. Oh, but *I'm* outta touch?!?!?"
  • "Say, didn't you support legislation discriminating against institutions' constitutionally protected right to freely exercise their religion?!?! Yeah? And that's *not* fringe behavior?"
  • "Given your vote on declaring Minnesota a 'sanctuary state' for trans youth, you must be OK with custodial parents having no say in the life-altering decisions their literal kids are about to make. Tell me how that's *not* extreme."


You get the idea. 

So going forward, all anyone associated with the MNGOP has to do is not behave in a crazy, ill-advised manner so as to bring unwanted attention onto the party. Simple enough, right?

Yeah, if you've paid even the slightest bit of attention to the party over the past dozen years or so, that's a pretty big ask

A GOP state senator and county chapters of the state Republican party have shared their support on social media for the Scott County Republicans’ Facebook post comparing President Joe Biden to murderous tyrants Adolf Hitler, Josef Stalin and Mao Zedong.

They are doing so in defiance of the state party, which denounced the comparison.

On June 10, the Scott County GOP posted on Facebook a meme with pictures of the dictators and Biden, under the words “Leaders who have their political opponents arrested.” The meme is an apparent reference to a grand jury indicting former President Donald Trump last week on charges relating to the mishandling of classified documents after leaving office and obstructing the government’s efforts to get them back.

Since the indictment, Republicans, including Minnesota congressmen Tom Emmer and Pete Stauber, have accused Biden — with no evidence — of weaponizing the U.S. Department of Justice against Trump.

The Republican Party of Minnesota called the Scott County GOP meme “uncalled for” and said “such rhetoric has no place in our political discourse.” The state party asked the Scott County Republicans to take down the post.

Eight minutes after the MN GOP post, Sen. Nathan Wesenberg, R-Little Falls, on his Facebook page posted the meme, with some passive-aggressive commentary.

“Apparently some people have problems with facts,” Wesenberg said in the post. Wesenberg declined to comment to the Reformer.


The one aspect of this story to which I take exception is lumping in Congressmen Tom Emmer and Pete Stauber with this group. As two people who witnessed firsthand the "Russia collusion" hoax, they surmise there's ample rationale that the DOJ is being weaponized despite this latest indictment of Trump looking as though it has teeth (again, multiple things can be true). But unless Reps. Emmer and Stauber also invoked Hitler et al, simple speculation on the DOJ's motivations here is not necessarily out of bounds. 


With the state of Minnesota teetering on the brink of becoming a cold California, any activity that repels potential new supporters is a veritable suicide pact. Now, I'm not all suggesting that elected Republicans or party officials need to lurch leftward. However, it would seem to be an obvious point that comparing political opposites to murderous dictators will do absolutely nothing to advance the center-right cause. The only thing such tactics accomplish is allowing the legitimately extreme elements of the party to partake in gnawing on political red meat. Like it or not, those people being the face of the MNGOP will ensure perpetual minority status. 


There's not a lotta time left to continue to recover from making these unforced errors.

Quick Hits: Volume CCCXVII

 - There's been no shortage of Minnesota Dems taking victory laps in the aftermath of the most radical leftist policies being jammed down the collective throats of citizens in this year's legislative session. The latest spiking of the football comes courtesy of Nebraska Fats Gov. Tim Walz in an appearance on MSNBC. 





Yeah, Walz has a funny way of determining what is and what is not people's business. 


 



Self-awareness is clearly not a left wing value. 



- That trusty ol' "tEh RePuBs ArE rAcIst" playbook was apparently shared with the folks at the most recent Tony Awards ceremony. 





I've said many time before that I didn't believe it was possible that leftists could become even more deranged after the George W. Bush presidency. Then came Donald Trump eight years later, to which I again said with certitude that the frothing proggie rage reached a fever pitch. Once again, I appeared to have erred in underestimating leftist invective. Lesson learned. 



- It was during his 2016 campaign for President that Trump proclaimed "I could stand in the middle of Fifth Avenue and shoot somebody, and I wouldn't lose any voters, OK?" In the aftermath of this latest indictment, there's no question some voters are going to peel away. But the cultists? Sadly, Trump's 2016 declaration may not be all that hyperbolic. 




 



With the indictment brought forth by Manhattan D.A. Alvin Bragg two months ago, even Trump-skeptical people like Mitt Romney were conceding that it smacked of a political witch hunt. But this latest Federal indictment undoubtedly has teeth to it. And the fact Trump cultists were willing to attack the substance of the former (and rightfully so) but not even address it in the latter tells me they know the charges are serious. Hence, the "tHeY'rE cOmInG fOr YoU nExT" chanting points in an effort to keep Trump afloat.

In this game, Orioles IF/OF Stevie Wilkerson pitched a 1-2-3 bottom of the 16th inning to secure his team's win. It marked the first time in MLB history that a position players earned a save.

Banana Republic stuff (UPDATE: Trump is a buffoon)

Multiple things can be true. 


  • Donald J. Trump should never be President of the United States again.
  • There is a two-tiered justice system where people like Hillary Clinton and Joe Biden seemingly get off scot-free while Trump is indicted for much lesser affronts. 
  • Trump's latest indictment is not over something petty or insignificant

First off, Andrew McCarthy of National Review lays out what is happening with this latest kerfuffle. 

The most notable thing I’ve seen is that, in charging Trump with an Espionage Act offense, prosecutors are relying on a provision that criminalizes willful violations of the rules that government officials are required to follow in handling national-defense intelligence. This seems like an obvious effort to distinguish Trump’s alleged crime from President Biden’s mishandling of classified documents, which the White House and the media-Democratic complex have described as inadvertent — the result mainly of sloppy staff work, not willfulness.

No one who has been following our analyses at NR will be surprised to hear that Trump is reportedly charged with a conspiracy to obstruct justice. What intrigues me about that allegation is that it takes two to tango — i.e., one can’t conspire alone. To have conspired to obstruct justice, prosecutors would have to prove that Trump had at least one co-conspirator who knowingly agreed to obstruct the government’s investigation. At this point, it is not clear with whom Smith alleges Trump conspired. When the indictment is made public, perhaps it will shed light on that question.

Trump is also said to be charged with making false statements. As I’ve previously related, one theory the special counsel appears to be pressing is that Trump is responsible for a false sworn statement his lawyers conveyed to the FBI — for transmission to the grand jury — on June 3, 2022.


In the short-term, this will actually elevate Trump among GOP voters in that they believe this to be a miscarriage of justice. But in the long-term, this will hamper Trump's ability to run for President. The lion's share of the money he raises will be used to pay legal bills, so he likely won't be on the campaign trail as often as he'd like. And while the Trump cultists will stick with him regardless, will there be enough GOP voters to peel away in order to elevate, say, Ron DeSantis as a legit threat to wrest the nomination away? Time will tell. 


So how will the other GOP hopefuls message this? Erick Erickson floats multiple scenarios, but I am most intrigued by this one. 


(They can) claim Trump is owed a debt of gratitude and this is all bad, awful, and unfortunate. But we need to find a candidate who can run unshackled to avenge Trump. Therefore, vote for me and I’ll honor Trump, win, and get revenge while he’s in court fighting them there. Not sure it will work, but it might. It really is, I think, a great pivot here for the rest of the field. Just argue that, however sad and unfortunate it is, Trump cannot both fight the feds, the City of New York, and Fulton County, Georgia while also fighting the Democrats politically at the same time. Promise to avenge the man if nominated and elected. Get the nomination, go after Biden on culture and pocketbook issues, then be a winner not named Trump. When the press demand to know if you’ll pardon Trump, smile with a twinkle in your eye, look straight into the camera, and say, “Elect me and find out.”


The non-Trump GOP hopefuls also need to stay on a general election message as well. The walking cadaver in the White House as been an abject failure as President and people are experiencing real world pain as a result. Naturally the media will look to keep the focus on Trump given he's their rating elixir, but there are workarounds in today's era of campaigning. Stay on message, gang!


Oh, and Erickson reminds us of one other legal saga that will soon emerge. 

 

.....Fulton County, Georgia will be indicting him too more likely than not. Drip. Drip. Drip. Drip. Drip.


Remember what a bizarre, surreal campaign we endured with the Trump-Clinton matchup in 2016? I now miss those gentler times. 


UPDATE: Trump was done in by his own arrogance and stupidity. No amount of "what about-ism" can overshadow that fact.

Quick Hits: Volume CCXVI (GOP presidential candidates edition)

 - Former VP Mike Pence officially enters the 2024 race. 


While Pence is definitely in my top 3 of preferred candidates to be the nominee, he unfortunately has no realistic path to the nomination. The Donald Trump cultists revile Pence the most of all the GOP prospects because he wouldn't subvert the U.S. Constitution to indulge in Trump's delusion of a stolen election. 





And because Pence actually served in the Trump administration, Dems will always tie him to that point in his political career no matter how honorable he's acted. 


Now, if Pence's only goal is to prevent Trump from being the nominee in '24, then that is perhaps the most noble calling he has undertaken. 


- On the other hand, a certain former New Jersey governor now resides in fantasy land





As I've mentioned before, Christie's potential prime time was 2012 was he enjoyed solid approval ratings as New Jersey's top executive. However, he was even past his prime when he entered the 2016 race, evidenced by finishing sixth in the New Hampshire primary, a contest which seemed to be the sole focus of his campaign. Christie then jumped on the Trump bandwagon shortly thereafter, but not attaining a prominent role in newly elected President Trump's admin rendered him irrelevant. The fact he says he's soured on Trump and looks to "go right through him" smacks of opportunism rather than Christie's claim of it being a "strategic error" of endorsing Trump in '16. 



- The shrill hags on The View often need to be knocked down a few pegs. Leave it to perhaps one of the most dignified members of the upper Congressional chamber to do so deftly. 






This further underscores my viewpoint that the most bigoted, racist rhetoric comes from progs when discussing minority and/or female conservatives. Kudos to Sen. Scott for pulling back that curtain.

With my friend and Northern Alliance Radio Network colleague Mitch Berg away on assignment, I will assume the reins of The Headliner this afternoon. The 2-hour broadcast gets started at 1:00 PM Central Time.
